CF02-002: AI Ethics Oversight Committee

AI Control Library / CF-02: Fairness, Bias & Rights Impact

Designation: Core | Control types represented: Operational

Control requirement

Establish a proportionate AI ethics oversight body with a clear remit, relevant expertise, access to evidence and defined authority to recommend, condition, escalate or withhold internal approval for consequential AI uses.

Why this matters

An advisory group can become ceremonial if it reviews presentations without the power to change decisions. Effective oversight requires an accountable route from an ethical concern to an enforceable organizational response.

How the control types work together

Operational controls establish the review, approval and follow-through processes described here. Their effectiveness depends on who performs the work, what evidence they use and how the findings change decisions.

When it applies

AI uses with material ethical or rights implications. Smaller organizations may use a qualified cross-functional panel or external expertise rather than a permanent committee.

Define the assessment boundary and potential harm before selecting methods. Record evidence gaps and a reasoned response; unavailable demographic data does not establish that the system is fair.

Ownership

The executive sponsor establishes the charter; the chair manages review and conflicts, and named business owners implement resulting decisions.

Implementation guidance

  1. Define the charter, decision thresholds, escalation authority and relationship to legal, risk and deployment approval functions.
  2. Include domain, technical, privacy and affected-perspective expertise; manage conflicts and obtain independent advice when needed.
  3. Require a review packet covering purpose, alternatives, impacts, uncertainty and proposed safeguards, with enough time for meaningful challenge.
  4. Record decisions, dissent, conditions and owners; verify action completion and revisit cases when material assumptions change.

How to verify it

Use an authorized evaluation or a representative sample of actual decisions and records. Establish the relevant population, evidence limits and acceptance criteria before interpreting a result.

Test Expected result
Trace a significant concern raised in review It produces a recorded decision, condition or escalation with an owner.
Inspect a conflict of interest Participation and recusal follow the charter.
Review an outstanding deployment condition Implementation is verified rather than assumed from meeting attendance.

Record a finding when required evidence or action is absent. Treat insufficient evidence as an unresolved limitation rather than a favorable result. A statistically observed difference requires contextual investigation and does not by itself establish its cause or legal meaning.

Evidence to retain

  • Oversight charter and authority
  • Membership and conflict records
  • Review packets and decision minutes
  • Condition tracking and follow-up

Protect demographic and other sensitive information with appropriate access, minimization and retention. Use privacy-preserving reporting where suitable, and prevent published small-group results from exposing individuals.

If the control fails

Escalate ignored conditions or unresolved material concerns to the executive risk authority. Restrict the relevant approval or deployment route until an accountable decision is made.

Example in practice

Hypothetical example: A committee questions whether a customer vulnerability score could disadvantage people already struggling to access services. It requires a narrower purpose, an impact assessment and a human challenge route before approving a pilot.

Review and maintenance

Review at the interval approved by the control owner and after material changes to purpose, population, data, decision rules or human workflow. Revisit relevant complaints, incidents and changed external obligations, and verify corrective action before closing findings.
